Last week Brian had his hearing for the assault on me back in November. As some of you may already know, he plead guilty and was sentenced to 1 year of probation and a 30 day jail sentence. However, his entire jail sentence was suspended. I wasn't sure what that meant, so I asked the city prosecutor. A suspended jail sentence means that he's not going to jail now but if he threatens me or scares me in any way then he goes to jail for his entire 30 day sentence.

The only reason the judge gave him a suspended sentence was because he's the sole provider for Tayler. His mom also made a point to say what a great and involved father he is because he's been taking Tayler to Cub Scouts and the night before the assault hearing he had taken Tayler to a book fair. Brian has never taken much of an interest in Tayler's "social" life (Cub Scouts, play dates, etc.) until right before his assault date. Ironic, isn't it?

It actually kind of infuriates me. . .

This coming Thursday is the hearing for temporary custody of Nathan. I don't anticipate that he's going to try for sole custody so I'm not afraid of losing Nathan. However, I AM afraid that he's going to want joint custody. As far as I know, if a person has "significant" history of domestic violence there is a law/statute that prohibits them from having sole or joint custody of a child. The only problem is what is considered "significant"? That seems open to interpretation, doesn't it?

 Anyway, wish me luck on Thursday! I've got to get some paperwork together and hopefully I'll be fully prepared for the hearing.
