can anyone help me out? My guy has two detainers on his record. They were JUST put there 6/24/08. I have no clue what detainers are, and if it will affect his sentence? I told him about them in a letter, and he has no clue what they are from. He asked me to try and figure it out, while he filed out some forms in there to see what it is. He said it would take him longer to find out because it takes 2 weeks just to see his councelor in there.

you cant quote me on this...but a friend of my husband and mine is in jail and his detainer is immigration. he is not a citizen. and when his sentance is over they might deport him. so that is one type of detainer. i am not sure if there are others.

this is what i found Regarding Detainers
What is a detainer? A detainer is a warrant placed against an inmate for pending charges from another jurisdiction. These pending charge(s) are usually from Florida counties and/or out-of-state law enforcement agencies. A detainer warrant may also be placed against an inmate who has had concurrent or consecutive sentences imposed in other jurisdictions. A third type of detainer one in which a jurisdiction wants to be notified of an inmate's pending release. Charges were dropped, why is the detainer still there? The charging agency has not officially notified the department of the removal of the detainer, or the cancellation is being processed. Please allow us two work weeks to receive and process the cancellation and post it to our computer database. hope that helps

Detainers are when you have commited crimes in another state and are waiting to be released so you can go to that state and do time there. My husband has detainers. When your guy finds out where and what they are he can file form 1389 and request that state come to get him so he can go before the judge and request his time run concurrent. Good luck.

wow...crimes in others states...? I know of none. I am really scared more so now. I called the prison, and they gave me some number to call. A court number. I did, the lady said it is probably because he broke his previous probation by commiting the crime he was sent to jail & prison for. Then she transferred me to the criminal finnancial lady, and that lady said the case # I gave her for the detainers said it had no money he owed...I am so confused. Money? other crimes? different state!? The phone is just a dumb game. No one on the phone ever knows anything! I am so frustrated.

I don't think it's possible to have a detainer for the crime you're in prison for. That makes no sense. You should try calling his lawyer or public defender and see if they can be more helpful. Good luck.

The crime does not have to be in another state. I am going through hell right now trying to get a detainer off my hubby's record. He had a charge come up after he was already in the prison system, and because of that... it was dropped. However, in the parole system, it still shows as a detainer. The county has dropped it, but has not notified the prison. So basically, a detainer is stating that if he was to get out of jail for whatever he is in there for right now... whatever county the detainer is in would be able to pick him up upon his release to take him right back.
There should be an actual detainer department if you call the county courts... hopefully someone will have some more information soon for you.

Your man needs to fill out a 180 day writ. The agency with the detainer HAS to come pick him up for the charges within 180days or they have to let it go. I would do it now, and get it over with before he leaves prison and may go back for more charges. Deatiners suck, I had to deal with that with my hubby.
