This post has beneficial information for people in the United States who are working and suffering with Endometriosis.
I am happy to report that the company that fired me for missing 1-3 days of work each month due to Endometriosis has settled the case against them! They fired me back in October, 2007, even though I had full disclosure and documentation of my illness, notes from my surgeon and doctors, and even though I was a top-ten performer. I opened a case against them with the California Department of Fair Employment & Housing (DFEH.ca.gov), and they helped fight my case for the past nine months. They knew I had a really strong case against the company. The company took its sweet time - it ignored requests from the DFEH until June, and then the DFEH set a hearing date against them. That got them to sit up and pay attention. My demands were: * Lost wages * Financial restitution for Emotional Pain and Suffering * Undergo sensitivity training for people with disabilities What I got from them was: * Lost wages * Financial restitution for Emotional Pain and Suffering * Undergo sensitivity training for people with disabilities * 'Fired' status changed to 'Voluntary Quit' status * Any employer who calls for reference will get a positive review of me I AM SO EXCITED!!! I really truly did not believe that the company would own up to its abuse. I truly thought they'd only try to give me a payout in exchange for them not having to admit any wrongdoing. I'm so near tears with relief that the company did what is right to correct their wrong. I was told by a friend who works in human resources for another company that my case was settled quickly. She says she's heard of cases that go on for a year or more. Be prepared to STAY STRONG and DON'T BACK DOWN against an abusive company. I want you to always disclose your illness to your human resources department, and always provide ample documentation of your illness, because you ARE covered under the Americans with Disabilities Act and your local labor board, as well as the federal Equal Employment Opportunity Commission (EEOC). I want you to NOT be afraid to step forward if you are being abused on your job. Save emails, chat logs, reports that show your stellar performance - anything that can and will be used against the company should they discriminate against you because of your illness. I was sending this information home to a private email account at the end of each day for months, because I knew that at any time, I could be fired without warning. We must not be afraid of our jobs! We must take a stand! You are strong and powerful! I believe in you - believe in your own Strength. :) Posted on 07/21/08, 09:07 pm |

Jamie: yes, per their policy, I had to bring in a doctor's note every time I missed work, and I complied. ALWAYS make a copy of the doctor's note before giving it to your boss or to H.R., and then send an email asking if they received your doctor's note - in case they come back later and say "you never gave us one".

It is a shame that you had to go through this, but I am so glad that you did, and that you were successful. Congradulations and you should be proud. It will not only benefit you, but others who suffer with this and work so hard.
Congrats!!

Thank you Valerie, I am glad that I went through it because I knew I had to. I knew I wanted to, despite how emotionally harrowing it was. I could have quit the company when I figured out I was being set up to be fired. I did that at another company that was going to fire me in 2006. But this time, I just had it. I'd had enough.
In accepting the fight, I knew that the end result would be two things: 1) My official exit from the computer industry, vowing never to return again, and 2) A strong and willful fight against the corporation to make them acknowledge their wrongdoing. Though I worried a lot over the past nine months that the company might get away with their abuse, I knew that how I handled the situation from start to finish was enough in itself to tell a story to help others fight the fight. I'm so glad it turned out in my favour - because it in turn is for all of us. I pass the torch and encourage everyone to continue to be warrior women we know we are. This illness cannot defeat us. It only makes us stronger.

Congrats and thanks for fighting for all the gals after you who won't have to go through this now. Employers need to understand that endo is serious and we can't be treated like that.....I once had my employer tell me she would have let me work part time if I "had something like cancer" but that endo was not like that. People need to learn that it affects work a lot and that an understanding employer can make a difference.
