so i went through surgery on my ankle last october. and i have had the cortisone/prednisone injections. but what i didnt know is when i went through the surgery the surgeon did something wrong.
he killed some of the nerves in my foot and now my muscles are atrophied. if we dont know what atrophy means. it means my nerves that sustained the muscles died and the muscles died because of it. since it has been 8 months since the surgery my PCP who is also a muscular and nerve specialist says the chances of the muscles returning are about 1% he said it may even get worse because the pain i am having is the type you have when your nerves are dying. he started me on gabapentin and tramadol for pain. also they scarred my foot up pretty badly when i got the cortisone/prednisone injection cause they used a can of dry ice to freeze my ankle so it wouldnt hurt.. (i think that hurt almost as bad as when i originally hurt my ankle) they somehow gave me frostbite. so i have a huge scar across the top of my ankle in the shape of a target symbol. i was in and out of the hospital for 3 days because of that one injection and he tells me because of the frostbite scar i prolly will not be able to get another injection if i needed it. i have had several people even other doctors tell me to file a lawsuit for malpractice. i dont want everyone to think that i am sue happy. cause im not. and i already have one suit going right now against the insurance company. now i have traumatic arthritis, sinnovitis, arthralgia and atrophy my PCP says i will not run again. i used to run 4-6 miles a day and this just kills me that i cant run. it was my only stress outlet. i love to run, to feel the wind on my face and the tightness in my chest. ugh. what do you guys think. would you file a lawsuit in this situation. i need opinions Posted on 04/18/08, 10:04 am |

I think if you are hurt and your life has to change because of some one elses actions you have every right to file a suit.
You have to think about what might happen in the future, not just now. And all the other medical thing's you will go through because of this. I say file the suit, that DR. need's to know what he has done to you.

i still have to talk to my lawyer about it he doesnt know that my muscles are in atrophy right now. but the doctor that did this to me is so kind and caring. i dont think he meant to have this happen.

If your condition became worse after the surgery because of a mistake you can try to build a case against the doctor but it's hard. I've never heard of a doctor using dry ice. That's crazy. That may give you a good case.
I have a friend that had hip surgery and they put her arm over her head during the surgery and left it there. By the time they had finished the surgery, they damaged nerves in her arm. She tried to file a suit but couldn't get anywhere so I will warn you that it's not easy. I thought my friend had a good case. GOOD LUCK!

I agree with everyone else. Yes, it sucks to be tied up in litigation, but in this case - you have things that have been done to you that are going to change the rest of your life. Not only is this something which isn't recoverable from, but it is something that the doctor who did it never let you know about.
This isn't you getting pissed off about a bad bedside manner. This is about something that will have an effect on the rest of your life, including your ability to take care of yourself to the fullest (such as if you got diabetes or heart disease, where a good exercise program can keep you off of medication). There is a lot to consider here. Take care, Laura

this is why they have malpractice insurance for these types of issues file a claim it is your right it will not be easy but having a bum ankle is not easy either
you may not want to do it now but think long term in five years when it may get worse you wont be Abel to file a claim depending on where you live and the statue of limitations get your lawyer to start it and have him do all the work take care and i am so sorry this happened i know no matter how much money you will get it will not take away the scars
