" It all depends upon the type of custody you have an where the jurisdiction of the case lies. Many states (if not all) requires a relocation petition and trial before you are able to move out of state with your children away from the other parent. call you local court, they will be able to tell you. "

" Assuming the other parent is involved, it really has to be okay with them, then talk to the court. There have been other posts on here about moving if you search back a little bit. In some cases where both parents are involved and the other does not want the children moved away, custody can be changed to the parent that is not moving. "

" Have you legally filed for a divorce? If so then probably not. You'd have had to go first then file in that state. That would have made him also have to come to you for all the court dates too. But in Texas I got slammed. I had to stay in the county my kids were born or contingent counties. Hope it helps....been there then after I moved he went in for child support after he got custody. I should have moved first! Oh well. "
