We are trying to get full custody of my step son who is 9. He is with us over the summer and we have recently been hearing an overwhelming amount of stuff about him being neglected and left alone when he is at home with his mother. We are in the state of Arizona and his mother resides in Texas. She has numerous accounts of cps claims against her, I was wondering if CPS can grant us temporary custudy while we hire a lawyer?

" Call Texas CPS and ask them. They won't give you specific information on her cases but you can learn how the system works.

Then you can petition Texas CPS directly to intervene. Maybe. My sons are trying to settle their mothers estate in Texas and need a attorney to do anything at all. "

" I live in Texas, and can tell you that you need an attorney to file for emergency temporary custody due to her neglect. I had to do this for my grandaughter and am currently going for full custody. Be sure and give the attorney any info about CPS being involed, also any statements from witnesses. "

" i would think if cps was too conserned they would have removed the child from the home already but i also know (friend who works for WI CPS) they do damn near everything to keep the child with the parent and out of foster care. with that said i would first contact CPS and let them know you are available to take the child at any moment and push them to investegate.... then i would contact a lawyer and file for emergancy hearing. If you know who keeps reporting her contact them and ask if they can be a material witness. "

" not sure about texas, in kentucky CPS can place a child as they see fit, especially if there is family willing to take the child instead of putting them in foster care, your best bet is take the advice from the others, do your homework and do whatever it takes to get custody. "
