I hope yall find this as funny as I do...

In my last post I mentioned that the ex had announced she retained a lawyer? That annoyed me a bit, until I did some checking around.

At the time she told me this (in IM's on AOL) she also said her lawyer would be calling my lawyer the next day, which would have been Thursday this week. I was puzzled by that because where we live thats a bit outside court protocol. The normal procedure in a civil matter, which a custody issue is, is for the opposing attorney to send a letter to the other party (in this case, me) informing me he represents my ex and yada yada yada. I've been involved in enough civil cases as a deputy sheriff to know this.

In any case, I called my lawyer this morning and asked if, in fact, her lawyer had called for any reason. I further qualified the question by asking if any lawyer had called claiming to represent the ex. Both my lawyer and his paralegal said no, no one had called about anything. I then gave them the name of this supposed attorney and got a "Who? Never heard of him." response.

As such things go in my neck of the woods, if you drop the name of a lawyer who supposedly handles custody cases and no one knows him/her, it generally indicates that person hasn't impressed anyone. The regular cluster of lawyers who take on such cases almost always know each other, if only by name. This one drew a blank.

Then I got to thinking...

This is the ex, once again, throwing out some bluster and bluff. The first question that came to mind was why wasn't she using the same lawyer she had for the divorce? That one handles custody cases too.

Answer: Her original lawyer told her she wouldn't touch the case with a ten foot pole. Its a no win case and no lawyer wants that.

As far as this other lawyer goes--I have no doubt she went to talk to him. I have no doubt he gave her some legal advice--during the 30 minute FREE interview which is standard practice for all lawyers in this area. If she didn't front him his fee up afterward, she didn't retain him past the that first 30 minutes. Had she done so, I would have received a letter today and there is an off chance he might have called my lawyer. Neither happened.

The long and short of this--she talked to this lawyer and he told her he would represent her--IF and when she paid him his fee. In her mind, it was enough to try to impress me that she retained a lawyer without really doing so. The one theme thru all this that has been consistent (on her part) is her strong reluctance to put out any money. She had said more than once, almost demanded, that we resolve this without lawyers involved. She said that from the beginning.

Now, eventually she may get up off some money for this guy and actually have a lawyer for the future court date. But right now, my money is on it being just another bluff, another attempt to intimidate me. With this wacked out woman, anything is possible. LOL
