My husband deserted me and committed adultery. My lawyer has told me that suing him for divorce on those grounds won't get me an extra .50 cents in my settlement. So, I have decided to let him file for divorce when he wants to and I won't contest it. ( I could file now because of the adultery, but I don't want to because when we get divorced I won't have health insurance). My question is, do any of you know if it will make a difference if I file on the grounds of desertion and/or adultery? Will a judge be more likely to give me a better settlement if I do this?

" What state are you in? I'm sure all this varies state-to-state. Here, in GA, my lawyer said I could probably ask for and be awarded all the equity in the house becaues my husband committed an affair. I told him no though because I wanted to be fair about everything-- unlike my husband!! "

" It depends on your state. BUT I have learned that it can affect alimony...my state is a no fault state BUT when I filed for alimony, the reasons for our divorce became a serious issue and his attorney was FREAKING out completely because my x was OPENLY living with another woman within a couple of weeks after our separation, and I had proof of drugs and alcohol abuse. "

" Filing did seem to give me the upper hand at first. Being served by the sherriff upset him horribly...he was livid. :) I didn't have to go through it. I felt a sense of empowerment by filing too...like I wasn't going to take any of his crap. My attorney seemed to think that it gave us the upperhand at trial. "
