In Australia its called a private agreement and is ok if both parties agree and it is in writing. Have no idea about the states (come tothink about it I am not sure why I posted that as it is pretty useless). Well at least I took the time to reply I suppose. :)

Of course different states have different laws. Do some research in your state to find out what they say. I know here in MD and in VA if you come up with your own agreement most the time the judge will agree with it.

Dude. If she says she is broke why would you agree to NOT pay child support? Can you really care for them 50% of the time? I don't know your story but if your kids are not emancipated and you are doing a full time gig, you are paying child support.

actually i did care for them moer than 50 and i do not want child support. No i will not pay i will take full cutody first

What is it about men and child support? Your not supporting her, your supporting your kids! Why do men think they are hurting the mother when it's the kids that get deprived? I don't get it! They brought these kids in the world too why do they want to get in a pissing match with the mom over supporting their own children??
It costs a fortune to raise them and usually the support doesn't cover it. I spend way more on my kids than their dad does even when he does send their support!

Hi. LouieJ. I think for the most part some men don't think that the money will be used to support the children completely. At least I hope that's the problem depending on the situation of the break-up the other half may be a flake when it comes down to money and maybe just giving an unfit parent money isn't always the best choice for the kids well being.

No matter what state law says...ANYTHING can be negotiated and put into t he divorce contract...remember, that's exactly what it is...a contract.

I am a paralegal from Baltimore and if you both are agreeable to custody just have your attorney put the conditions that you agree to and draw up an agreement. The court will probably place an order that the mutual agreement is in force. BUT, have an attorney draw it up. You guys may agree now but there is language that is put in a separation agreement that is conditional to change of status on either of the parties.

In my state, the court usually has a "formula" in which they calculate child support based on both parties income. Most couples cant come to an easy agreement so that's great if you two are able to work it out that way!
