Take him for child support AND spousal support. If you've been married after so many years, you can ask for spousal support. I worked part-time for 16 years while raising our two children. Was able to get spousal for three years and child support until each are 18 years old. Get an attorney who is a tiger~~

My stbx got the screw job!! It is always based on both incomes if you have an income. But Every state has a Child Support Guideline they have to follow. In my case I have been a stay at home mom the entire marriage and he makes really good money. Most of his pay is now gonna go to me for child and spousal support, plus 10 months of back pay cuz the F**ker didn't think he had to pay before we went to court. WRONG!!! The only problem after he gets ordered to pay, is getting them to actually pay it. I have an income deduction order. The money comes right out of his paycheck. He missed his first payment in JAN, cuz the IDO hadn't started yet, so now he has to go to court again for contempt.

CS depends on state guidelines. A lot of states use an income share model. It's based on income, not credit or living expenses. He'd likely be ordered to help pay for medical as well. For example...mine and my x's total monthly income is added together...my pay makes up 32% of the income share and his makes up 68%. There is a scale that tells the amount of support that our children should get based on our total income. He has to pay 68% of that amount and I have to pay 32% of that amount. He gets a credit for providing their insurance based on the amount he pays. If child care was necessary, he would have to pay a portion of that as well. He's also been ordered to pay 68% of all medical...copays and amounts over insurance including dental. You really need an attorney to help you figure it out. If you are paying for the 4 wheeler, the car, and the truck, you should have those in your possession or the ability to sell those.
