I hope this is the correct place to post this. I wonder if anyone can help me. I have been divorced over three years, I live in Wisconsin, my ex lives in Indiana, I have never been a resident there. We built a home in Indiana, his name was on it, as we were going to add me later. People have told me that he should have been made to sell the house and give me half or something like that...Being the house was built in 2003 and we divorced in 2004, I guess there was no equity or not much in it, not sure what equity means, I guess that's the amount you have put into your mortgage? Should he have been made to sell the house or something like that and have given me half? And is it too late to go back to court? I think I have heard under certain situations, it can go back to court. Otherwise, there was a 90 day appeal date, which I DIDN'T know about because my lawyer withdrew, prior to the final divorce hearing More information, if it's of importance: I had my lawyer withdrawal going through the divorce, and had another breakdown ( I'm mentally ill ). Lawyer feared getting paid because my then husband lost his job and I was told he was responsible for my legal bills. I couldn't qualify for pro bono because we were still married and our income and assets were too high. He wouldn't give me money for another attorney and I couldn't represent myself in court, being I was so sick. And he didn't give me money to get to the final hearing, had I been well. When I took $500.00 out of our joint checking account for a lawyer, he was livid and switched everything to his own private checking account in Indiana, it was in Wisconsin before. I had no access to it, and my lawyer said it was barely legal what he did. But he did give money as I needed it. In the divorce I got one of the cars, my mobile home and we gave each other things from the homes that we wanted. I didn't get spousal support because it would effect my SSI. But at the last minute, before the final hearing, I found out he could have paid some of my bills; called "vendor bills" and it wouldn't effect my SSI as much. Him paying my lot rent, gas and electric and etc.. He knew this but remained silent at the hearing about this. As it tuns out, I got help for these things to pay, but he still could have paid my car insurance, home insurance and maybe a few more things... I live in poverty and barely make it and am wondering if any mistakes were made in the process of our divorce. ( he divorced me ). My divorce decree says something about I was to not to receive spousal support because I was not disabled at the time, as I had to wait until we were divorced to apply for SSI, because our income and assets were too high to apply before. Can anyone see that there were mistakes made in this divorce? And I thank you so very much! Forgot to say, we have no children. And that my ex filed for bankruptcy and listed me as a creditor, ugh! Legal Aid in Indiana (had to go through Indiana) said they didn't have the resources to help me, I guess that means money... I have a couple of other places to try yet. Posted on 12/29/07, 03:12 pm |

Well, one thing is that:
equity = fair market value minus the mortgage(s) or other encumbrances on the property.

I dont know about your divorce but I was told that you can not file for bankruptcy to get out of joint debt.

Under the divorce decree, he was to take all marital debt. And when he filed for his bankruptcy, he took my debt as well, I guess they can still come after me, but they haven't as of yet, and it's been three years.

I agree with reply #2. I think bankruptcy would apply to your ex's social security number so any debt that is in his social would be covered. Some debts may try to come after you saying you were married at the time. If you have debts in your social or cosigned loans I would be suprised you haven't been contacted by now.
