Hey guys...does anyone know how it's decided who ends up paying counsel/attorney fees? My plaintiff hubby filed, has requested counsel fees, when we both made the same income and had entirely separate finances during marriage, and by the way he's liquidated our joint bank account took out all the money without my knowledge (only way i found out was that i happened to be checking balance statement on phone)... i have my own attorney fees to pay $375/hr (!) My thought on this is that he's the one who's filed, he's the one who's hired his own lawyer, why do i have to pay his fees? i've my own lawyer fees to deal with... any thoughts from anyone who's already been through it?

" Have your attorney contact his attorney. You are NOT going to pay his lawyers fees. He needs to get over it. It's a 50/50 deal. "

" It's just all tactics and legal dance. He will have to provide a reason why he wants you to pay his fees, there is all kinds of stupid stuff the lawyers ask for whether you think you can get it or not at first and then it gets whittled down and the judge decides alot. Even after you're divorced depending on what you end up back in court for, say anything to do with child support or visitation, can be changed at the whim of the judge. The legal is system is NOT what it's cracked up to be! You can request your lawyer fees paid, who knows, the judge might say alright since he started it, you never know. "
