My nephew came to live with me 9 months ago...as a favor to my brother whose working 5 hours away.. anyhow he was trying to take my laptop computer from me (in fun) and I was trying to stop him even though I had repeatedly told him not to do this he thought it was funny and continued to... anyhow the screen got broke... me trying to be fair said I would buy a computer and expect him to pay 1/2 of the cost when he had the money probably working during the summer...
Anyhow it came up again recently and he says he only owes me 1/2 the replacement cost of the old computer minus depreciation... appears he's been speaking to someone... he doesn't even have remorse over breaking the computer ... I feel I could have made him pay the full cost but thought I'd give him a break but he says its my fault as well since I was grabbing it from him... I said if he wasn't trying to take it from me I wouldn't be grabbing it... Anyhow..sorry to be so long what would you do in this situation? Posted on 05/14/08, 08:05 pm |

Legally he is right, morally he is wrong and way off base. Which do we prefer to value as family, friends and humans? I think the moral road is the better road. How you handle it is up to you, but legally he is correct on this one. He would only be ordered to pay half the cost of the current value of the laptop. Unless he was proven 100% responsible for the accident. Which that could also happen.
I'm glad not to have broken mine yet.. LOL. I've dropped it on the floor a few times, and have been lucky every single time.

I think you are right in making him pay for half of the replacement cost of a laptop... as long as it is one similar to the one that got broke, and not some expensive extravagant one that has all the bells and whistles that the other one didnt.
He is legally correct though, but sounds like he needs to take the moral road here.

Thanx for your replies.. I'm going to call the shop I bought the old computer at tomorrow and find out what replacement cost would be and have him pay 1/2 of that.. he is 100% responsible since he was being rough in trying to take it from me.. but the moral issue aside I'll just get the replacement value.. the new computer is the same as the old so I would be ok either way.. thanx again

Maybe it's just me here but you said the new PC is the same as the old one? I'm assuming new PC is the one you just bought? Seems to me whatever that cost would be the replacement value - if your looking to be nicer about it find out the difference between what you just paid and what it would be to replace the screen of the old one and let him off the hook with the cheaper price - but yeah he should have to 'fix what he broke' GL
