currently i am tied up in a lawsuit involving 2 people and 1 insurance company i am involved in a claims battle with one insurance company from the car wreck i was in. everyone knows that chronic pain goes up and down and you have some good days where you can do more things than other days where you cannot do anything.

what i am worried about is the insurance company(s) hiring private investigators to take pictures of me for court on my (few and far in between) good days where i can drive my car and go for a walk in the park. the days where if i try very hard i can hide my limp and pretend all this has gone away and i am normal. and everyone i walk by in the stored and in the park or restaurant think that i am normal. i fear that they will try to use these pictures or videos to say i am faking my injuries and the jury will not award the money i need to pay the rest of my bills.

is there any way to check in like a database or something to see if they have hired private investigators so i can know if i am being recorded? i am worried that they will throw out the pictures of me crying in public because i have walked for longer than a half hour or because someone made a rude comment because sometimes i have to use the electric wheel chair at wal- mart in order to do my weekly grocery shopping. im worried they will see these pictures and throw them out and keep the pictures of the occasional smile and of me walking right.

How do i deal with this in court? i get very emotional when people attack my permanent injury or just me. i know if they start to say anything about me just being a victim in a car wreck that is faking for the money i will lose it. i almost ended up in jail last time someone said something about me being a "faker".

i am very intimidated by these insurance companies and their ways of doing things and im very nervous. does anyone know of anything i can do or will i just have to deal with people following me around and taking pictures and what not to try to destroy my credibility. what can i do??!!??!!??!! how can i tell if they are following me around?????

Tricia
by the way thanks for letting me vent.

" I have no information as far as how to tell if an insurance company has hired an investigator or not, but do you have a lawyer on your side? In my case I had a lawyer and never had contact with the insurance company at all. I'm not sure how much money you are looking for, but in my case the limit of the insurance that the man who hit me had was 15,000 and that is all I got regardless of my medical bills. I am looking at having to pay medical bills of more than 200,000 dollars. I was also unlucky in the fact that the man who hit me had nothing. By nothing I mean he lives in a camper on a piece of land the county has paid twice to clean up because he dumps garbage and junk there. I would not think that you would not need to worry as long as medical evidence backs up your claims. I agree with you that some times you have good days and others days horrible. I understand that first hand. I have a problem with people thinking I should be better now, so that means I am faking. I understand your worry and really hope everything turns out for the best. Please know that I am here to talk anytime. "

" Hi. I hope you have a lawyer that is on your side. If I were you, I would assume you are being watched & followed. They will look for anything to prove you are lying about your condition. They don't care about having a good or bad day or the comprehension that on a good day you can do or at least try to do things you wouldn't even consider on a bad day.
About the only advise I could give is to be honest and NEVER say you can't do something. Try things like,,,, I haven't been able to accomplish it yet,,, or I have trouble with trying to do that,,, or it isn't something I can do yet. Then if they take a photo of you carrying a bag of groceries for example what difference would it make if you haven't said you can't do it? Does that make sense?
Hope that helps. Good luck. "

" You need a LAWYER NOW!
I do know from working in workers comp that they do, and probably are doing this.
Its not hard to spot, they sit in cars and watch your house. I honestly would give them as much ammunition as posisble. Wear the neck brace. Go in the wheel chair. Make them see.
I feel your pain sweetie, and its not fair.
but if you've been given an impairment rating from your doctor they cant just dismiss that . regradless of whatever pics they have.

you can hire a private investigator too ya know. someone on your side to take pics of you and your struggles.

I wish you all the luck . "
